SMS Terms and Conditions

These SMS Terms and Conditions (“SMS Terms”) govern text message communications sent by Soul Ventures DBA The Wellness Universe and its affiliated companies, brands, programs, and services (collectively, “The Wellness Universe,” “we,” “us,” or “our”).

By voluntarily providing your mobile telephone number and affirmatively opting in to receive SMS or text messages from Soul Ventures DBA The Wellness Universe, you agree to these SMS Terms.

1. SMS Consent

The Wellness Universe sends SMS/text messages only to individuals who have affirmatively agreed to receive such communications from us.

You may provide consent through an online form, registration page, event registration, membership process, program enrollment, text-to-join process, or another method that clearly identifies that you are agreeing to receive text messages from The Wellness Universe.

By opting in, you authorize The Wellness Universe and its service providers acting on our behalf to send SMS or MMS messages to the mobile number you provide.

Consent to receive text messages is not a condition of purchasing any product or service unless specifically permitted by applicable law.

We do not purchase lists of mobile telephone numbers for unsolicited SMS marketing, and we do not knowingly send promotional SMS messages to individuals who have not opted in to receive them.

3. Message Frequency

Message frequency varies depending upon the program or communications you have chosen to receive.

Some periods, events, programs, or launches may involve more frequent messaging than others.

The Wellness Universe does not guarantee a specific number of messages per day, week, or month unless otherwise stated at the time you enroll.

4. Message and Data Rates

Message and data rates may apply.

Your mobile carrier may charge you for sending or receiving SMS or MMS messages according to the terms of your wireless service plan.

The Wellness Universe is not responsible for any message, data, roaming, or other charges imposed by your mobile carrier.

5. How to Opt Out

You may withdraw your consent and stop receiving SMS messages at any time.

To opt out, reply:

STOP

to any SMS message you receive from us.

You may also use other commonly recognized opt-out words where supported by our messaging provider.

After you submit an opt-out request, you may receive one final message confirming that your request has been processed. After that confirmation, we will no longer send SMS messages covered by that consent unless you subsequently opt in again.

We will honor valid requests to revoke consent in accordance with applicable law.

Opting out of SMS communications does not necessarily unsubscribe you from email communications, membership communications, or other forms of communication you have separately agreed to receive.

7. Your Responsibility for Your Mobile Number

You represent that you are the subscriber or authorized user of the mobile telephone number you provide to us and that you are authorized to consent to receiving messages at that number.

If your mobile number changes or is transferred to another person, you agree to opt out of our SMS program or otherwise notify us so that messages are not sent to an unintended recipient.

You agree not to provide a telephone number belonging to another person without that person’s authorization.

8. Automated Messaging Technology

Some SMS communications may be sent using an automated telephone dialing system, automated messaging platform, or similar technology.

Your consent to receive marketing SMS messages may include communications transmitted using automated technology where permitted by law.

Consent to receive automated promotional text messages is not required as a condition of purchasing goods or services.

Your consent to receive SMS communications from The Wellness Universe applies to The Wellness Universe and the affiliated companies, brands, programs, or services identified or reasonably described when you opt in.

11. Supported Carriers and Delivery

SMS services may not be available through every mobile carrier, device, or geographic location.

Delivery of text messages is subject to effective transmission by your wireless carrier and our messaging service providers.

The Wellness Universe is not responsible for delayed, undelivered, duplicated, or misdirected messages caused by mobile networks, carriers, telecommunications providers, technical failures, incorrect telephone numbers, or circumstances outside our reasonable control.

12. Eligibility

You must be legally permitted to enter into these SMS Terms.

If you are under the age of majority in your jurisdiction, you should not enroll in promotional SMS communications without the consent of a parent or legal guardian where required by law.

13. Prohibited Use

You may not use our SMS program in a manner that:

  • Violates applicable law
  • Interferes with the operation of the messaging service
  • Attempts to gain unauthorized access to our systems
  • Uses automated methods to abuse or manipulate the SMS service
  • Harasses, threatens, or unlawfully communicates with our team or service providers

14. Modification or Termination of the SMS Program

The Wellness Universe may modify, suspend, or discontinue all or part of an SMS program at any time.

We may also revise these SMS Terms from time to time to reflect changes in our services, technology, operational practices, or applicable law.

The “Last Updated” date appearing at the beginning of these SMS Terms identifies the most recent revision.

15. Compliance With Applicable Law

Our SMS communications are intended to comply with applicable U.S. laws and regulations governing telephone and text message communications, including applicable provisions of the Telephone Consumer Protection Act (“TCPA”) and Federal Communications Commission (“FCC”) regulations.

Nothing in these SMS Terms is intended to waive any rights or obligations that cannot legally be waived.

SMS communications may contain general wellness, educational, event, membership, promotional, or informational content.

Unless expressly stated otherwise, SMS communications are not intended to constitute medical, psychological, legal, financial, or other licensed professional advice.

17. Limitation of Liability

To the fullest extent permitted by applicable law, The Wellness Universe and its affiliates, officers, directors, employees, contractors, and service providers will not be liable for damages arising solely from delayed, failed, incomplete, or misdirected SMS communications caused by telecommunications networks, wireless carriers, service interruptions, device incompatibility, or circumstances outside our reasonable control.

Nothing in these SMS Terms excludes or limits liability where such limitation is prohibited by law.
